Please read these terms carefully before using TenDotNine

1. Acceptance of Terms

By downloading, installing, or using TenDotNine ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, please do not use our App.

2. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use TenDotNine on your iOS devices for personal, non-commercial use.

You may:

  • • Download and install the App on devices you own or control
  • • Use the App to track your shooting performance
  • • Export your data for personal use

You may not:

  • • Modify, reverse engineer, or create derivative works
  • • Sell, rent, lease, or commercially exploit the App
  • • Remove any proprietary notices or labels
  • • Violate any applicable laws or regulations

3. Subscriptions & Payments

Free Tier:

  • • Track up to 5 training sessions per month
  • • Access basic analytics (7-day history)
  • • Single discipline tracking

Premium Subscription:

  • • Unlimited training sessions
  • • 365-day history and advanced analytics
  • • All ISSF disciplines
  • • Export functionality (CSV/PDF)
  • • iCloud backup

Billing Terms:

  • • Payment will be charged to your Apple ID account
  • • Subscription automatically renews unless canceled 24 hours before period ends
  • • Manage subscriptions in your App Store account settings
  • • No cancellation of current subscription during active period
  • • Prices may vary by location

4. Apple's Licensed Application End User License Agreement

This agreement incorporates Apple's standard EULA terms:

a. Scope of License:

This license is limited to non-transferable use on Apple-branded products you own or control, as permitted by Apple's Usage Rules.

b. Maintenance and Support:

We are solely responsible for providing maintenance and support. Apple has no obligation to furnish any maintenance or support.

c. Warranty:

We disclaim all warranties to the maximum extent permitted by law. In case of any failure to conform to warranty, you may notify Apple for refund of the purchase price. Apple has no other warranty obligation.

d. Product Claims:

We are responsible for addressing any claims relating to the App, including product liability claims, failure to conform to legal requirements, and consumer protection claims.

e. Intellectual Property:

We are solely responsible for any intellectual property infringement claims. Apple is not responsible for investigation or defense of such claims.

f. Legal Compliance:

You represent that you are not located in a U.S. embargoed country or on any U.S. prohibited party list.

g. Third Party Beneficiary:

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them upon your acceptance.

5. User Content & Data

You retain all rights to your shooting data and performance information. By using TenDotNine:

  • • You acknowledge that all data is stored locally on your device
  • • You are responsible for backing up your data
  • • We are not liable for any data loss
  • • You can export or delete your data at any time

6. Disclaimers & Limitations

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TenDotNine is not intended to:

  • • Replace professional shooting instruction
  • • Guarantee performance improvements
  • • Provide safety training or guidance

Safety Notice: Always follow proper firearm safety protocols and local regulations. TenDotNine is a tracking tool only and does not provide safety instruction.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8. Indemnification

You agree to indemnify and hold harmless TenDotNine, its developers, and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tamil Nadu, India.

10. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of TenDotNine after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to TenDotNine immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.
